These Terms of Use (“Terms”) govern your use of dracarys.finance (the “Site”) and the services of Dracarys Finance LLC (“Dracarys Finance”, “we”, “us”). By using the Site or submitting a request, you agree to these Terms and to our Privacy Policy. If you use the Site for a business, you agree on behalf of that business and confirm you are authorized to do so. If you do not agree, please do not use the Site.
Dracarys Finance LLC is a commercial finance broker. We are not a lender, bank, investment adviser or broker-dealer, and we do not make loans, credit decisions or investment decisions. We help businesses find and compare financing from independent third parties, such as banks, SBA lenders, credit unions, private funds, alternative lenders, investors and buyers (“Providers”).
Our Services are for commercial financing for business purposes only. They are not for personal, family or household purposes. By using the Services you confirm that any financing you seek is for business purposes.
You must be at least 18 years old, able to enter into a binding contract, and acting for a business operating in the United States. You may not use the Services if you, your business or its owners are subject to U.S. sanctions or appear on a U.S. government restricted-party list.
We are usually paid by the Provider when financing is funded. In some cases a fee may be paid by your business, and if so it will be agreed with you in writing in advance. Where required by law, the amount or method of our compensation will be disclosed to you.
Content on the Site, including guides, examples and comparisons, is general information. It is not financial, legal, tax, accounting or investment advice and may not fit your situation. Examples and figures are illustrative. Please consult your own advisors before making financial decisions.
By submitting a form you agree that we may contact you about your request by phone call, text message, WhatsApp and email, including by automated means, as described in our Privacy Policy. Message frequency varies; message and data rates may apply; consent is not a condition of any purchase. Reply STOP to opt out of texts and HELP for help.
You agree to receive notices, disclosures and records from us electronically, and that electronic signatures and records have the same effect as paper ones. You can request a paper copy by writing to us.
You agree not to: use the Site for any unlawful, fraudulent or misleading purpose; submit false information or information about another person without permission; impersonate anyone; interfere with or overload the Site; try to access systems or data without authorization; introduce malware; use robots, scrapers or other automated means to copy or monitor the Site without our written permission; or use the Site to send spam or harass anyone.
The Site and all its content, including texts, names, logos, designs, colors, structure, ideas and product concepts, belong to Dracarys Finance LLC or its licensors and are protected by law. DRACARYS™, Dracarys Finance™ and DRACARYS Media™ are trademarks of Dracarys Finance LLC. You may view the Site for your own use; any other use requires our written permission. If you send us ideas or suggestions, we may use them without obligation to you.
Offers you receive come from Providers under their own terms and privacy policies. Links to other websites are provided for convenience; we do not control and are not responsible for their content or practices.
The Site and Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Site will be uninterrupted, error-free or secure, or that any financing will be offered or approved.
To the fullest extent permitted by law, Dracarys Finance LLC and its members, managers, employees, agents and partners will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, business, goodwill or data, arising from or related to the Site, the Services, any Provider or any financing, even if advised of the possibility. Our total liability for any claim related to the Site or Services will not exceed the greater of the amount you paid us for the Services in the 12 months before the claim, or one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of them may not apply to you.
You agree to defend, indemnify and hold harmless Dracarys Finance LLC and its members, managers, employees and agents from any claims, losses and expenses, including reasonable attorneys’ fees, arising from your use of the Site or Services, information you provide, or your breach of these Terms or of any law or third-party right.
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute arising from or related to the Site, the Services or these Terms will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to their jurisdiction. To the fullest extent permitted by law, any claim must be brought individually and not as a plaintiff or class member in a class or representative action, and you and we waive the right to a jury trial.
We may suspend or end your access to the Site or Services at any time if you breach these Terms or if we believe it is needed to protect us, our partners or others. Sections that by their nature should survive will survive.
We may update these Terms. The date at the top shows the latest version. Continued use of the Site after changes take effect means you accept the updated Terms.
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, with the Privacy Policy, are the entire agreement between you and us about the Site; separate written agreements govern any specific engagement or financing.
